Terms of sale

So, you've come to the place where the boring fine print is that nobody reads, but bear with me.

The owner of this online store www.kioko.ee is Kioko OÜ (registry code 16565320), located at Telliskivi 60a/1, 10412 Tallinn.

Prices

The prices of the products sold in the online store are indicated on the product and category pages. All product prices are in euros and include VAT. Depending on the amount of the purchase, transport may be added to the prices (see delivery). In the case of discounted campaign prices, the product page shows both the new price and the old price crossed out.

The online store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer, if the price of the goods in the online store is marked significantly below the market price of the goods due to an error.

Making a purchase

Add the desired products to the shopping cart, fill in the empty fields, indicate whether you want deposit packaging or recycled packaging, and choose the delivery method (parcel machine or pick-up).

NB! Only recycled materials are used in the packaging of the product, from the stickers to the packaging material and the box.

If there is a discount code, it must be added BEFORE paying for the purchase. You can add the discount code to the "Coupon code" box under the products in the shopping cart. To activate, press "Use Coupon" and then "Update Cart". Only one code can be used per order.)

Then you can see the amount that needs to be paid and you can do it safely through Estonian bank links, credit card or Apple Pay and Google Pay . When paying with a bank link, be sure to press the "Back to the merchant" button on the bank's page.

Payments are mediated by Montonio Finance UAB. Payment is made outside the online store in a secure environment. The seller does not have access to the customer's bank data.

The sales contract between Kioko OÜ and the customer enters into force from the receipt of the amount to be paid according to the order confirmation to Kioko OÜ's current account. Products will not be reserved before the sales contract enters into force.

In stock vs made to order?

Kioko OÜ does everything possible to ensure that the stock levels stated in the e-store correspond to reality, but a situation may arise where the stock level stated on the product page is not correct. If you have ordered a product that has actually run out, we will contact you as soon as possible to see if you would like the product with a backorder, and if not, we will issue a refund for the missing product.

If you have ordered a made to order product, please note that it takes up to two weeks for the product to be ready.

NB! Carefully consider each purchase to avoid unnecessary overproduction and consumption.

Delivery

KIOKO currently offers the possibility to send the order to the following countries: Estonia, Finland, Latvia, Lithuania, Sweden, Norway, Denmark and the United Kingdom.

To pick up the goods in Estonia, the buyer has the following options: Itella, Omniva and DPD parcel machines, and with prior agreement, self-pickup in Pelgulinn, Tallinn.

We post the products in stock on the working day following the order at the latest, and they usually reach you within 1-3 working days from the day of posting. We will made to order products as soon as they are ready.

Delivery times may be longer due to holidays, promotions or circumstances affecting transport service.

Shipping cost for orders within Estonia

When choosing Itella, Omniva and DPD parcel machines, the fixed price is €3. Picking up by appointment is free of charge.

Free delivery

Deliveries are free within Estonia for orders exceeding 50€.

International deliveries are free for orders exceeding 150€.

Deposit packaging

If you chose the KIUD deposit package (a good choice!), you have to pay a deposit of 3 euros for the package when making the purchase. When the order reaches you, you need to scan the QR code on the package and return the empty package to the Tango return box. Tango return boxes can be found here. Then 3 euros will be transferred back to the account number specified by you.

NB! Packages must be returned within 60 days.

NB! Tango return boxes are currently only in Estonia.

Returns

Products purchased from Kioko OÜ can be returned within 14 days of receiving the product. The product must be posted via Itella, DPD or Omniva parcel machine to Kioko OÜ's address within 14 calendar days from receiving the product.

For products subject to a refund, we will reimburse you within 14 days of the returned product's arrival at our warehouse. The online store may refuse to issue refunds until it has received the item that is the subject of the contract or until the buyer has provided evidence that it has returned the item, whichever occurs first.

Returning orders within Estonia is free.

The condition of the returned product

* The product to be returned must not be damaged. If the product to be returned has deteriorated and the deterioration is caused by circumstances that are not due to Kioko OÜ or the non-intended use of the product, Kioko OÜ has the right to offset the decrease in the value of the product with the amount paid by you for the product and due to be returned to you. Kioko OÜ will send you an application for settlement.

* The product to be returned must not have signs of use. If it turns out that the product has been used, KIOKO will be guided from the principle of reasonable use - if the product had to be tried on to make sure it was not suitable, the product is considered unused. Kioko OÜ has the right to offset the decrease in the value of the product due to use with the amount paid by you for the product and due to be returned to you.

The product to be returned must be accompanied by product labels. 

Kioko OÜ is not responsible for defects that have occurred after the goods have been handed over to the buyer.

The right to file a claim

The online store is responsible for the non-compliance of the goods sold to the buyer with the contract conditions or for a defect that already existed at the time of handing over the item.

The online store is not responsible for defects that have occurred after the goods have been handed over to the buyer.

The buyer has the right to contact the online store within two months at the latest if a defect appears, by sending an e-mail to info@kioko.ee.

The online store is not responsible for defects that have occurred after the delivery of the goods due to the consumer's actions or inaction (incorrect use, accident, etc.) or if it is normal wear and tear due to normal use of the item.

If the goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store will return to the buyer all fees associated with the sales contract.

The online store responds to the consumer's complaint in writing or in a form that enables written reproduction within 15 days.

If the buyer and Kioko OÜ cannot resolve the dispute by agreement, the buyer can appeal to the Consumer Disputes Commission. Who is responsible for what?

Kioko OÜ is responsible to you, and you are responsible to Kioko OÜ to the other party for the damage caused by violation of the terms of this agreement in the cases and to the extent provided by the legislation in force in the Republic of Estonia.

Kioko OÜ is not responsible for damages caused to you or for delays in product delivery if the damage or delay in product delivery is due to a circumstance that Kioko OÜ could not influence and the arrival of which Kioko OÜ did not and could not foresee (force majeure).

Kioko OÜ is not responsible for product loss or damage that has occurred after the product has been handed over to the carrier.

Kioko OÜ is responsible for you to the extent of the selling price of the product. Kioko OÜ does not take responsibility for damages caused by defective products, such as damage to property or information, loss of turnover or profit.

Privacy

By using the Kioko OÜ e-store and staying on the page, you give your clear and informed consent to us processing your personal data and using the cookies necessary for the best online experience under the conditions set forth in this agreement.

The personal data made known to Kioko OÜ is entered into the customer register and used only to process the order and send the goods to the buyer. Kioko OÜ sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed his wish to do so by entering his e-mail address on the www.kioko.ee website and has indicated his wish to receive direct mail notifications.

Our customers can opt out of offers and newsletters sent to e-mail at any time by notifying them via e-mail or by following the instructions in the e-mail containing the offers. The customer also has the right to ask for information about the data we collect at any time - we will be happy to answer you.

Kioko OÜ is the responsible processor of the client's personal data and forwards the personal data necessary for making payments to the authorized processor Montonio Finance UAB.

Your personal data, which are necessary for the delivery of the goods, will be transmitted to the company providing the courier service only to the extent necessary.

The protection of personal data is ensured by all security measures resulting from the law. Kioko OÜ undertakes not to transfer registered personal data to third parties or to use personal data contrary to the law or this agreement.

Modification of Terms

Kioko OÜ has the right to change and supplement the terms and price list of this contract due to the development of the e-store and in the interests of better and safer use of the e-store.

Changes and additions to the terms and conditions and price list take effect from the publication of the corresponding change or addition on the website www.kioko.ee. If you submitted your order before the changes to the conditions entered into force, the legal relationship between Kioko OÜ and you will be subject to the conditions in force at the time you submitted the order, unless otherwise provided by law or the terms of this agreement.

Just in case, I would also like to mention that in addition to these terms and conditions, the legal relationships that arise when purchasing from the e-store www.kioko.ee are regulated in the Republic of Estonia applicable legislation. It may not be possible to write everything here, but the mandatory information is should be here nicely.
